3/26/07: HB1347 Needs Your Action

HB1347, that expands the immunization tracking system to include all ages was pushed through 2nd reading in the house on special orders. Third and final vote will be Monday, 3-26 anytime after 10:00 am.

If you are concerned about being put into a database without your consent, being put on a "non complier list" if you chose not to vaccinate your children or yourself according to the federal government one-size-fits-all immunization schedule and not being able to remove ALL of your information from the immunization tracking system, please contact members of the Colorado House before Monday at 10:00 am.

Action Needed!

3 points to make:

1. - Your Private Health Information, including immunization information, can be gathered and disclosed for "public health activities" because of HIPAA, without an authorization.

HIPAA allows protected health information to be used or disclosed without written authorization or the opportunity to object for many reasons including public health surveillance, investigations and interventions and to an official of a foreign government. http://www.hhs.gov/ocr/combinedregtext.pdf (pages 24 through 29) The immunization tracking system is "interoperable with electronic health records".

HB-1347 allows information to be gathered without consent on all ages, not just children, from; practitioners, clinics, schools, parents, individuals, managed care or health insurance plans, hospitals, the dept. of health care policy and financing and persons and entities that have contracted with the state. 2. - OPT-OUT only removes shot information, other information stays in the database.

According to information on the CIIS (Colorado Immunization Information System) web site and the bill, only shots can be excluded, other information stays in the system. You can choose at any time to have your child's shots excluded from the Colorado Immunization Information System.

3. Children who exempt from any vaccines are reported.

F. If the school chooses to use the immunization tracking system to monitor compliance with the school law and the parent(s), or student submits an exemption, the school must submit the exemption information to the immunization tracking system. Section 15-4 [PDF]

CRS - 25-4-904 Rules and regulations immunization rules rule-making authority of state board of health.The state board of health shall establish rules and regulations for administering this part 9. Such rules and regulations shall establish which immunizations shall be required and the manner and frequency of their administration and shall conform to recognized standard medical practices. Such rules and regulations may also require the reporting of statistical information and names of noncompliers by the schools.
